In Nebraska, Connerly’s NCRI (Nebraska Civil Rights Initiative) to amend the State Constitution to prohibit affirmative action programs was approved on November 4, 2008. 58% of voters voted for the initiative, while 42% of voters voted against it. Nebraskans United, the coalition that came together in support of affirmative action, campaigned against the initiative and brought a lawsuit challenging Connerly’s fraudulent signature gathering processes. However, in January 2009, the court upheld the legality of the petition drive and rejected Nebraskans’ United’s legal challenge. The group has decided not to appeal that decision.
